In the Bankruptcy Court, the Tort Claimants Committee (or TCC), is tasked with protecting the interests of all survivors that filed claims in the Boy Scouts Bankruptcy. To that end, the TCC negotiates with various parties, makes recommendations to survivors, and advocates in Court filings and pleadings. Christopher Hurley and Evan Smola of Hurley McKenna & Mertz, represent nearly 4,000 victims, including one victim that is a member of the TCC. Hurley McKenna & Mertz participates in all TCC calls, negotiations, and strategic decisions made on behalf of HMM clients and survivors everywhere.
We wanted to update you on the Boy Scout Bankruptcy and inform you that the Tort Claimants Committee (the TCC) will be holding a second Town Hall to further update victims nationwide.
Negotiations continue with the Boy Scouts of America, Local Councils, and the insurance companies that provided insurance coverage to the Boy Scouts. We continue to meet multiple times per week with the TCC, mediators, and working groups focused on the insurance disputes as well as the Local Council contributions to the bankruptcy. We expect the Boy Scouts to file a proposed plan of Reorganization next week and you may hear about this plan in the news. This plan will likely call for the BSA insurance policies to be placed in a trust which will further litigate the insurance disputes. We will provide our analysis of the plan to you once it is filed. Please understand that the filing of a plan does not mean the case is settled. The Court is a long way from approving a plan and a case can continue in litigation or negotiations even after the plan is accepted by the Court. No aspect of this highly complex bankruptcy has been settled to date.
The law firm of Pachulski Stang Ziehl & Jones, LLP, the firm representing the TCC, will once again be hosting a Town Hall. That meeting is set for Thursday, February 11, 2021 at 8:00 PM (Eastern).
