On Aug. 31, Hurley McKenna & Mertz (HMM) filed an additional 12 misconduct lawsuits against OB-GYN Vernon Cannon and his former employer DuPage Medical Group, now Duly Health & Care. These new lawsuits accuse Cannon of performing exams while intoxicated and acting inappropriately during exams. They accuse DuPage of negligence.
The lawsuits include:
Borkowski v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Bozich v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Carrion v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of acting inappropriately during a routine exam.
Carlson v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a pap smear while intoxicated, resulting in the patient suffering from type 2 and 3 dysplasia.
Grayczyk v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Griseta v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Hess v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Livingston v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a vulvar biopsy while intoxicated.
Pohlman v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Ramirez v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a routine exam and conducting a fertility consult while intoxicated.
Rivera v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of providing post-partum care while intoxicated.
Viviano v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a routine exam and ultrasound while intoxicated.

The plaintiff accuses Cannon of performing numerous exams while intoxicated.
Fuentes v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of delivering her baby while intoxicated.
Gudella v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of acting inappropriately during an exam and performing the exam while intoxicated.
Vernon Cannon’s History of Misconduct
Cannon’s history of inappropriate behavior and intoxication didn’t begin there, though.
In January 2023, HMM filed five separate misconduct lawsuits against Cannon and DuPage. These included:
Bretana v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing an exam while intoxicated.
Jane Doe v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of trying to start a sexual relationship with the patient.
McKay v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
O’Leary v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of bizarre behavior following a stillbirth.
Stortz v. Cannon and DuPage Medical Group
The plaintiff accuses Cannon of performing a prenatal exam while intoxicated.
Those lawsuits followed a similar Complaint at Law HMM filed in January 2020 that accused Cannon of sexual assault and DuPage of negligence, as well as a medical battery lawsuit HMM filed against him in August 2022.
Though Cannon has been the subject of numerous misconduct reports by patients to DuPage Medical Group, the plaintiffs allege that DuPage did nothing over a prolonged period of time to investigate the reports or discipline him. In fact, after two of the reports, Cannon was disciplined, not for his actions, but for not generating enough revenue for the practice group.
